Child Care Licensing Procedure Manual
The following are the most common types of stipulations:
Stipulations that set forth conditions of licensure relating to the physical plant or premises;
Stipulations that limit the number of children in care in a family child care setting that is also a family foster care home;
Stipulations that spell out an agreement with BECR that certain conditions will be met in order for BECR to grant a license or continue a license, usually executed instead of issuing an enforcement action;
Stipulations that settle an applicant’s or licensee’s appeal of an enforcement action, negotiated to rescind the enforcement action and set forth requirements to address and remediate the compliance issues highlighted in the enforcement;
Stipulations that BECR and the licensee agree to, with the assistance of the OLC, to settle a dispute regarding the content of the enforcement action, such as an agreement to reduce the forfeiture amount from the original assessed forfeiture assessment amount. These are referred to as stipulated settlement agreements.
