13. Removal of a Stipulation

The licensing specialist may consider a request from the licensee for re-evaluation of the need for the stipulation during the licensing period, if the licensee can demonstrate a significant change in circumstances since the original stipulation was executed. The licensing specialist should consult with the licensing manager/licensing supervisor in making a decision to remove a stipulation from a license. The licensing specialist may also initiate removal of a stipulation, with the approval of the licensing manager/licensing supervisor.

In any case, at license continuation (or relocation), the licensing specialist must review and re-evaluate the stipulation to determine if it should remain in effect for the new licensing period.

If a stipulation is withdrawn, the licensing specialist will note the action taken and the withdrawal date on the licensing specialist’s copy of the stipulation. One copy of the stipulation, indicating that the stipulation has been withdrawn and the withdrawal date, is sent to the licensee and one copy is uploaded in WISCCRS. If the stipulation was identified on the license certificate, a new license is issued to remove the notation of the stipulation from the license. When a stipulation is removed as a license condition, the licensee’s monitoring plan must be reassigned accordingly.
