11.1 Required to Post

Under Wis. Stat. § 48.70, each license granted under Chapter 48 must state the name and address of the licensee, the maximum number of children in care, their age and sex, and additional information and special conditions as BECR may prescribe. A stipulation states the special conditions of the license, and is, therefore, considered a part of the license. (Note: A stipulated settlement agreement may not be considered a condition of the license, but may state the conditions for settlement of an enforcement action only. Posting only occurs if specifically included in the stipulated settlement agreement.)

The posting requirements for family child care, group child care and day camp licenses are set forth in Wis. Stat. § 48.657(2g), and Wis Admin Code DCF 250.04(2)(i), 251.04(2)(L) and 252.41(1)(L). The stipulation, as part of the license, must be posted next to the license certificate in an area visible to parents unless posting requirements are specifically excluded from the conditions. In addition, the license certificate will indicate that a stipulation is in place, with the notation, “See Posted Stipulation dated mm/dd/yyyy” or “Family Child Care/Foster Care Stipulation dated mm/dd/yyyy”. The licensing specialist should remind the applicant/licensee that the stipulation must be posted next to the license as soon as it is effective and it must remain posted as long as the stipulation is in effect.

All stipulations, with the exception of certain stipulated settlement agreements that do not specify posting requirements, are identified on the Regulated Child Care and YoungStar Public Search website in either the Conditions Details section or the Regulation Details section or, in the case of a stipulation following an enforcement action, both of these sections.
