Once the revocation is initiated, it takes effect immediately and the licensee has ten calendar days from the date the Notice of Revocation to appeal the revocation. The licensee is allowed to operate during this 10-day period and, if appealed, during appeal proceedings. However, pursuant to Wis. Admin. Code §§ DCF 250.11(9)(b), 251.11(8)(b) and 252.05(8)(b), child care centers and day camps may not accept for care any child not enrolled and in care as of the date of receipt of the notice without written approval of BECR.
If the statutory basis for the revocation requires a written Notice of Revocation 30 days prior to the date of revocation, as permitted under Wis. Stat. §§ 48.715(4)(a) or 48.715(4)(d), the licensee may continue to operate for that thirty day period to correct violations. However, if the violations remain uncorrected at the end of the 30-day period, the revocation becomes final. This type of revocation may also be appealed when the initial notice of the 30-day revocation is issued and if appealed, the licensee remains open during appeal proceedings.
