A copy of the Notice of Revocation is sent certified mail and regular mail. In rare situations and only with the concurrence of the licensing manager/licensing supervisor, the Notice of Revocation may be hand-delivered to the licensee. This generally occurs because the licensee has refused to accept the certified mail delivery. In this case, the licensing manager/licensing supervisor or another specialist should accompany the licensing specialist to the facility to deliver the document. In some situations, it is also advisable to request the assistance of law enforcement.
If hand-delivery is necessary, the licensing specialist must document the date, time and persons involved in the hand-delivery. If possible, the licensing specialist should request that the licensee sign a Delivery of Document Receipt. A standardized format for this receipt is available on the BECR Intranet. If the licensee refuses the hand-delivery, the notice is left at the facility. The person accompanying the licensing specialist serves as a witness to the delivery and signs the Delivery of Document Receipt.
Occasionally, a licensee will voluntarily surrender his/her license before the Notice of Revocation is delivered in an attempt to negate the revocation. Once a revocation is initiated, it must be processed as a revocation even though the licensee wishes to voluntarily surrender the license. Only the most serious violations lead to revocation; completing the revocation is the only way to ensure that should the licensee reapply for a license in the same or a different region, the violations that led to revocation will be known and re-licensing can possibly be prevented. In accordance with Wis. Stat. § 48.715(5), BECR may deny licensure to any person who has had a license or probationary license revoked within the previous five years and, in accordance with Wis. Admin. Code §§ 250.11(2)(g), 251.11(1)(h) and 252.05(10)(h), BECR cannot process an application for a license if the applicant had a license to operate a child care center or day camp revoked within the previous two years. It is also important that a Wis. Admin. Code § DCF 13-related revocation is recorded as such so that the action will be reflected in future Integrated Background Information System (IBIS) search results.
