An order to close intake may be issued when the licensee has failed to correct the administrative rule violation(s) identified on the CFS-294, Noncompliance Statement and Correction Plan, a warning letter, and/or an order to correct in the specified time frame. This type of order is usually issued when facility cleanliness or general disrepair issues have not been addressed through previous monitoring efforts. This order is also issued when staffing issues are exacerbated by the enrollment of additional children. When this order is in place, the licensee may not increase the number of children enrolled in the facility and may not replace currently enrolled children whose care is terminated while the order is in effect. Because an order to close intake results in a limit on the number of children the licensee can care for and thus has financial implications for the licensee, the consequences of this type of order on the licensee are similar to that of imposing forfeiture. Therefore, the order should be carefully considered in consultation with the licensing manager/licensing supervisor to determine whether to impose an order to close intake or to proceed to the next enforcement step, forfeiture.
Other agencies that have an involvement with the licensee should be informed of an order to close intake in case they may also need to monitor numbers of children in care for USDA food program reimbursement or Wisconsin Shares payments.
