An order to implement and comply with a BECR plan of correction is imposed when the licensing specialist, in consultation with the licensing manager/licensing supervisor, has determined that certain, specific measures must be taken in order for the licensee to achieve compliance with the administrative rule. In particular, this type of order is needed when an immediate correction of a serious rule violation is required to prevent harm to children. For example, after an incident in which a child in care is lost on a field trip, the licensing specialist may require, through a BECR plan of correction, that the licensee immediately implement a specific procedure developed by BECR that will prevent this situation from reoccurring. Likewise, the licensee may be ordered, through a BECR plan of correction, to immediately implement revised procedures for transporting children or to cease transportation services following a transportation incident that threatened the safety of children in care. In addition, an order to implement and comply with a BECR plan of correction may be needed in the following circumstances:
The licensee has either failed to submit a plan for correcting a statute/rule violation(s) identified in a CFS-294, Noncompliance Statement and Correction Plan, or has failed to submit a plan that is acceptable to BECR. The plan may be too vague, incomplete or the proposed correction date(s) is untimely, necessitating that the licensee implement a plan developed by BECR;
Despite providing a correction plan and time line in response to a CFS-294 that BECR approved, the licensee has either failed to implement their correction plan or the licensee’s correction(s) have failed to bring the licensee into compliance within the time line; thus, BECR orders an alternative and effective plan of correction;
The licensee has failed to make the corrections needed to comply with an order to correct within a reasonable time frame, so BECR orders a plan of correction to address the violation(s). In this case, if the licensee is not complying with an order to correct, the licensing specialist should consider, in consultation with the licensing manager/licensing supervisor, the likelihood that a BECR plan of correction will gain compliance from the licensee. The licensing specialist may instead decide to proceed to the next enforcement step—forfeiture—as an alternative to issuing an order to implement and comply with a BECR plan of correction.
