5.2 Ensuring Compliance with the Order

The licensing specialist must monitor the date when the plan of correction is to be submitted to BECR. The time line for complying with the order is set by the licensing specialist, based on the seriousness of the violation(s), and should not exceed 90 days from the date of the order. In very unusual circumstances, at the request of the licensee, the licensing specialist may, in consultation with the licensing manager/supervisor, grant an extension to the expected date for submittal of the plan of correction. This would usually only apply when the circumstances causing the delay are outside of the licensee’s control, such as an absence due to illness.

The licensing specialist must assure that the plan of correction has been submitted within the time frame set forth in the order (or the ruling for the state following an appeal of the order). If the licensee does not submit a plan of correction within the time frame outlined in the order, the licensing specialist should consult with the licensing manager/licensing supervisor regarding the enforcement action that should be taken next, such as forfeiture. Once the licensee submits the plan of correction, as instructed in the order, the order is considered closed.
