An order to submit a plan of correction may be issued under the following circumstances:
The licensee has failed to respond to a CFS-294, Noncompliance Statement and Correction Plan, by correcting the administrative rule violation(s) or submitting an acceptable plan for correcting a rule violation(s) within the time frame specified in the CFS-294. The plan for correcting a rule violation may be too vague, incomplete or the proposed corrections date(s) is untimely;
Despite initially submitting a satisfactory correction plan with an acceptable time line in response to a CFS-294, the implementation of the correction plan has failed to correct the rule violation(s) within the time line; thus, an alternative and effective plan for correcting the violation(s) is required of the licensee;
The licensee has failed to implement the steps needed to comply with an order to correct within a reasonable time frame. In this case, the licensing specialist should consider, in consultation with the licensing manager/licensing supervisor, the likelihood that an order to submit a plan of correction will gain compliance from the licensee. The licensing specialist may instead decide to impose a BECR plan of correction or proceed to the next enforcement step—forfeiture—as an alternative.
