Child Care Licensing Procedure Manual
The licensing specialist must issue an order if s/he is citing at least four repeat, serious violations during a single monitoring visit. However, the licensing specialist may, with the concurrence of the licensing manager/licensing supervisor, waive this requirement if s/he believes that there are extenuating circumstances that should prevent issuance of an order. The extenuating circumstances include the following:
The provider’s previous compliance history has been satisfactory and, based on previous experience with the licensee, the licensing specialist believes it is likely that compliance will be achieved without the order.
The violations do not appear to be part of an ongoing pattern of the center but appear to be an unusual and one-time only occurrence that is not expected to be repeated.
The provider appears to be making significant progress toward correcting one or more of the violations but has not yet accomplished what is required to verify correction of all violations.
There are conditions outside the control of the licensee, such as an illness, that impact the licensee’s ability to address the violations.
The licensing specialist should present the extenuating circumstances to the licensing manager/licensing supervisor to determine whether the requirement to issue the order can be waived and the length of time that will be afforded the licensee before an order is issued.
