4.1.1 When More than Two Years have Passed Between Cites for the Same Violation

Should the same violation be cited again more than two years from the date when it was previously cited, the violation is treated as a new violation rather than a repeat violation. Although the licensing specialist is not required to go directly to an enforcement action based on the past violation, s/he can issue an order with the CFS-294 and note the date that the violation was previously cited.
