If termination of the employee is ordered, the licensing specialist must verify that the termination has occurred within the 30-day time frame set forth in the order (or the ruling for the state following an appeal of the order). This verification can be made through an on-site visit or through written confirmation from the licensee. In very unusual circumstances, at the request of the licensee, the licensing specialist may in consultation with the licensing manager/licensing supervisor grant an extension to the expected date for termination. This would usually only occur when the circumstances causing the delay are outside of the licensee’s control, such as absence due to illness.
If the licensing specialist determines that the employee has not been terminated as required in the order, the licensing specialist should consult with the licensing manager/licensing supervisor regarding the enforcement action that should be taken next, such as forfeiture. If the licensing specialist confirms that the employee has been terminated as ordered, the order is considered closed.
