3.1 When to Issue an Order to Terminate Employment

The licensing specialist must determine if the employee has regular, direct contact with children in care and if the specific behaviors that led to the employee’s previous license revocation could affect the employee’s ability to safely care for children in the facility. If, in consultation with the licensing manager/licensing supervisor, it is determined that the employee’s previous behavior as demonstrated by his/her revocation history continues to pose a threat to the health, safety and welfare of children in care, the order to terminate employment should be issued. On the other hand, it is possible that the employment of the person in a properly supervised setting poses no such threat despite a revocation history and an order to terminate employment is not indicated. As an alternative to issuing an order to terminate employment, the licensing specialist may issue an order that the licensee ensure proper supervision of the employee. In this case, the licensing specialist may require that the licensee/employer submit a plan of supervision for the employee, which is subject to the approval of the licensing specialist, or may order the supervision as a Department-imposed plan of correction.
