Child Care Licensing Procedure Manual
The licensing specialist should make a site visit within two (2) months of the date of the order (or the ruling for the state following an appeal of the order) to verify that the individual is in compliance with the order. If possible, this site visit should be scheduled in conjunction with a scheduled visit to another center in the area. If the on-site visit reveals that the provider is operating illegally despite the order, the licensing specialist should consult with the licensing manager/licensing supervisor regarding what enforcement action should be taken next, such as forfeiture or referral to the District Attorney for an injunction or prosecution.
For more information regarding how to address compliance issues with unlicensed providers, refer to the chapter titled Complaint – Unlicensed Facilities in the Complaint/Incident Investigations section of the manual.
