2. Issuing an Order to Stop Operating

An order to stop operating compels a person to stop operating a group or family child care center or day camp if the entity is operating without a license in violation of Wis. Stat. § 48.66(1), or without a probationary license in violation of Wis. Stat. § 48.69.

When BECR has verified that a child care provider is caring for a licensable number of children without a license,  the licensing specialist consults with the licensing manager/licensing supervisor regarding issuing an order as the first enforcement step. The order, signed by the licensing manager/licensing supervisor, states that the provider must immediately stop providing illegal care and outlines additional enforcement actions that may be taken if the provider fails to comply with the order. A standardized format of the order to stop operating an illegal child care center is available on the BECR Intranet.

Any person aggrieved by a Department action taken under Wis. Stat. §§ 48.715, 48.68(1) and/or 48.686, has the right to an administrative hearing under Wis. Stat. § 227.42. Pursuant to Wis. Stat. § 48.72, the written request must be sent directly to the Department of Administration, Division of Hearings and Appeals, no later than 10 days from the date of the notice. If the provider appeals the order and prevails, the case is closed. If the provider does not prevail, the order stands and the licensing specialist should then proceed with the follow-up on-site visit to verify compliance with the order to stop caring for a licensable number of children.
