Orders are subject to appeal through an administrative hearing as provided for in Wis. Stat. § 227.44. Wis. Stat. § 48.715(2) requires that BECR provide written notice of the grounds for the order and an explanation of the process for appealing the order. When a licensee appeals the order, the licensee is permitted to continue operation without fulfilling the order pending the outcome of the administrative hearing.
The licensee must appeal the order within 10 calendar days from the date of receipt of the order by sending a request for an administrative hearing to the Department of Administration, Division of Hearings and Appeals (DHA). DHA conducts the administrative hearing. Upon receipt of the request for a hearing, DHA notifies the Department’s Office of Legal Counsel (OLC), who represents BECR at the hearing, that the hearing has been requested. DHA will also notify the licensee and the OLC attorney representing BECR of the date, time and place of the hearing. The OLC, in turn, will forward the request to the regional office where the hearing information will be entered into WISCCRS and the licensing specialist will be informed.
The licensing specialist must ensure that all documents related to the hearing matter are uploaded into WISCCRS and should provide other information as requested by the OLC attorney in preparation for the hearing. The licensing specialist and/or licensing manager/licensing supervisor usually present testimony in person at the hearing.
