Child Care Licensing Procedure Manual
Child care licensees must display the notice of forfeiture beside their license in accordance with Wis. Stats. § 48.657(2g) and Wis. Admin. Code § DCF 250.04(2)(i), 251.04(2)(L) and 252.41(1)(L) until the licensing specialist informs the licensee that it can be removed. For direct forfeitures, this would occur after the forfeiture has been paid, assuming no further violation of the rule that led to the direct forfeiture. When an order has been issued, removal would occur when the violations cited in the order have been corrected and verified.
If a follow-up inspection verifies that an order has not been complied with by the specified time, or has been violated, a new forfeiture may be assessed. In accordance with Wis. Stats. § 48.715(a)1, the licensing manager/licensing supervisor may set forfeiture amounts that increase, within the statutory limit, if there is continued failure to comply with an order. Stronger enforcement steps may be considered for continued noncompliance. These include:
Suspension of a licensee’s license for not more than two weeks
Refusal to continue a license or probationary license
Revocation
Summary Suspension, if imminent danger exists
