When a forfeiture is appealed, payment is suspended until 10 days after the provider receives the final decision from the administrative review; or if the licensee petitions for judicial review under Chapter 227, within 10 days after receipt of the final decision of judicial review. When the final decision upholds the forfeiture, the licensing specialist prepares a notice for the signature of the licensing manager/licensing supervisor that informs the provider that payment is now due. Standardized formats of notices to licensed and unlicensed providers are available on the BECR Intranet in the Forfeitures standardized formats section. The forfeiture is withdrawn if the Department’s action is not upheld.
Occasionally, due process may result in a stipulation that allows the licensee to invest the forfeiture amount in meeting a center need, for example, the purchase of equipment or training, rather than paying it to the State School Fund.
