To request an administrative hearing under Wis. Stats. ยง 227.44, the aggrieved person must appeal the forfeiture in writing to the Division of Hearings and Appeals (DHA), Department of Administration, no later than 10 days from the date of notice of forfeiture assessment. The DHA is required to hold a hearing within 30 days after they receive the request unless the aggrieved person consents to an extension of that time.
The DCF Office of Legal Counsel (OLC) represents BECR in all contested cases. Often there is an attorney to represent the center. The licensing specialist and/or licensing manager/licensing supervisor generally participate as a witness in the hearing.
