If the 10-day payment deadline passes without receipt of payment, the licensing specialist may be asked to provide assistance to ensure that the forfeiture is paid. If payment is not received within 30 days, regional office staff will send a notice to the licensee that the forfeiture remains unpaid, after verifying this with the BECR central office manager.
State law provides that the Department may ask the attorney general to bring an action in the name of the state to collect any forfeiture that has not been paid. However, the more usual approach is to inform the licensee that authority exists under Wis. Stat. § 48.66(5) to revoke the license at the point of next license continuation. This usually results in payment of the forfeiture.
Pursuant to Wis. Stat. § 48.66(5), a licensee who has applied for a continuance of a two-year regular license must pay any and all outstanding licensing fees, background check fees, forfeitures, non-sufficient fund fees and late fees before the license may be continued. All fees and forfeitures must be paid before continuation unless the currently licensed provider has entered into an installment agreement or the provider has filed for bankruptcy protection. If an approved forfeiture installment agreement is in place at the time of continuation, the licensing manager/licensing supervisor will consider the licensee’s history of making timely installment payments in determining whether to continue the license.
