Child Care Licensing Procedure Manual
After determining the need for assessing a forfeiture and determining the amount, the licensing specialist drafts the notice of forfeiture assessment (and orders, if applicable) utilizing the appropriate standardized format available on the BECR Intranet. The available standardized formats are:

The standardized formats contain the statutorily required notice language; however, the unique case detail and relevant rule violations must be added. Special attention must be given to drafting the notice so that the reasons for the enforcement action are clearly articulated. It is critical to include all violations that are the basis for the action as it is impossible to prove something at a potential hearing, later, that is not identified in the notice. The licensing specialist must ensure that:
Violation(s) of the law/administrative rule occurred, or, the licensee failed to comply with an order and
All facts of the violation are accurately and concisely documented, including dates, times and locations and
The correct rule citation is used to describe the violation and
The amount of the forfeiture is commensurate with the violation.
The licensing specialist shares the draft notice and all supporting documents including a copy of the orders, if applicable, with the licensing manager/licensing supervisor for review.
The licensing manager/licensing supervisor is responsible for the final review of the forfeiture notice to ensure that the elements listed above are included and complete and accurate. S/he then signs the final notice of forfeiture assessment.
