2.2 Calculating Forfeiture Amount

Baseline Ranges are included in the Forfeiture Assessment Guidelines worksheet. A Baseline Range is the dollar amount starting point in a calculation of a forfeiture amount. Baseline Ranges vary, depending on the type of violation. For example, the starting point for a forfeiture of a violation of license capacity is $100 to $200, while the starting point for a violation of a background check requirement is $200 to $400. From these starting points, each factor being considered (such as severity, good faith, financial impact, etc.) may increase or reduce the baseline amount. Thus, a forfeiture for a violation of a background check requirement may begin as a $300 forfeiture, based on the Baseline Range, be reduced by $75 due to mitigating factors, but increased by $50 due to aggravating factors, resulting in a forfeiture assessment of $275.

The licensing manager/licensing supervisor must approve all forfeiture amounts and notices before they are sent out.
