2.2 Notifying Other Agencies

The licensing specialist or other assigned staff person uploads copies of the signed Notice of Denial into WISCCRS. The following individuals/agencies receive a copy of the denial via email:

Upon receiving the Notice of Denial, other interested entities will also take action in response to the denial. For example, upon receipt of a Notice of Denial of a regular license, the Bureau of YoungStar designates the provider holding a probationary license to be out of regulatory compliance and YoungStar staff change the provider’s YoungStar rating to one star. This action also suspends the provider’s Wisconsin Shares payments until the denial is finalized and/or the appeal, if applicable, is resolved. Likewise, reimbursement from the food program administered by the Department of Public Instruction, Child and Adult Care Food Program, is terminated when the program is informed that the regular child care or day camp license is denied.

BECR regional office staff may also notify other involved individuals/agencies in their region of the denial either verbally and then through follow-up with a blind copy of the applicable Notice of Denial; or, just simply by sending a copy of the notice electronically, through the mail or by fax. Note: It is the responsibility of the provider to communicate with other agencies should s/he remain in operation pending a hearing request. The local individuals/agencies that BECR may also inform include the following:

Because of the unique circumstances related to the appeal and resolution of a denial due to tax delinquency or delinquent Unemployment Insurance contributions, the notification of other agencies of this type of denial is handled differently. Other interested entities are not immediately notified of the denial and therefore will not take action in response to the denial until the Department of Revenue or Department of Workforce Development affirms that the denial has been finalized and all appeal options have been exhausted. Thus, the provider is not immediately deemed to be out of regulatory compliance and the provider’s Wisconsin Shares payments are not immediately suspended. Likewise, reimbursement from the food program administered by the Department of Public Instruction, Child and Adult Care Food Program, is not terminated until a final determination from the Department of Revenue or Department of Workforce Development.
