If a household member or employee is barred under the background check law, the license application may be withdrawn. This is done in lieu of license denial if the barred individual moves out of the facility either on a temporary basis (for example, while seeking rehabilitation review approval or until charges are disposed of) or on permanent basis. In this case, BECR enters into a stipulated agreement with the applicant. The BECR regional office creates the stipulation, outlining the conditions and restrictions that ensure the provider prevents the barred person from being a resident. BECR does not have the authority to disregard the background check law and the stipulation cannot violate or contradict the background check law by allowing a household member who has a barred offense to reside in the home. For example, BECR may not enter into a stipulation that prevents a household member with a barred crime from being on the premises during child care hours but still allows residence at the home.
