Child Care Licensing Procedure Manual
After receiving the authority to proceed with the denial from the licensing manager/licensing supervisor and the BECR director, the licensing specialist drafts the Notice of Denial. The draft is developed utilizing one of the following standardized formats, found on the BECR Intranet:

Denial – 30-Day Notice of Tax Delinquency
Denial – Notice of Unemployment Insurance Delinquency
The standardized formats for denial contain the statutorily required notice language, however, the unique case detail must be added. It is critical that the reason(s) for the denial is clearly articulated, that all relevant statute and/or rule cites are identified and that all facts related to the reasons for the denial are accurately and concisely documented, including dates, times, and locations of observations that led to the denial decision. The specific circumstances that require license denial should be stated only once. It is important to keep in mind that should the denial be appealed, the Notice of Denial becomes an important reference document in preparing for the administrative hearing.
The licensing manager/licensing supervisor is responsible for ensuring that the Notice of Denial is properly drafted and may have it reviewed by the OLC attorney before the final document is signed by the licensing manager/licensing supervisor. The original is then sent to the licensee through certified and regular U.S. mail.
As soon as the notice is finalized and sent, the denial is entered into the Enforcement module in WISCCRS. If a child abuse and neglect investigation finding is the basis of the revocation, all child protective service reports are uploaded in the Confidential Documents section in WISCCRS.
If the denial is appealed by a provider holding a probationary license and the facility remains open during appeal proceedings, the denial must be posted next to the probationary license in the center and is identified in the Regulation Details section of the Regulated Child Care and YoungStar Public Search website. The denial itself is not posted on the public search website. If the denial is not appealed, the facility closes and drops off the public search website.
