1.5 Refusal to Process a License Application

It is not a denial of licensure when the application for a child care or day camp license is not accepted and processed. Under certain circumstances, as required in Wis. Admin. Code §§ DCF 250.11(2)(g), 251.11(1)(h) and 252.05(10)(h), BECR may not process an application for a family or group child care or day camp license if the applicant has had a license or certification to operate a child care center revoked or denied within the two years prior to the date of the application.

In this case, the applicant is deemed ineligible to submit an application for a license. The application is returned to the applicant using the standardized format letter titled Return of Application Materials and Refusal to Process, found on the BECR Intranet. Since this is not considered a denial of licensure, it is not an enforcement action that can be appealed under Wis. Stat. § 227.42.
