Child Care Licensing Procedure Manual
The statutory authority to deny a probationary or regular license to operate a child care facility is provided under Wis. Stat. §§ 48.715(3),(5), (6) and (7); 48.68(1); and 48.686(4m) and (5m). The bases for denial are:
A revocation within the previous five years of a license issued under Wis. Stat. §§ 48.66(1) or a probationary license issued under Wis. Stat. §§ 48.69.
Failure to pay court-ordered child or family support, maintenance, birth expenses, medical expenses, or other expenses related to the support of a child or former spouse.
Liability for delinquent taxes and delinquent Unemployment Insurance contributions.
Actions of the applicant or an employee of the applicant that constitutes a substantial failure to protect and promote the health, safety, or welfare of a child.
Evidence that the licensee, a household member, an employee, or person with regular contact with children in care, has been convicted of a serious crime as defined under Wis. Stat. § 48.686(1)(c), or is the subject of a finding by a governmental agency of neglect or abuse of a client, misappropriation of a client’s property, or child abuse or neglect.
Conviction of an offense that is not a serious crime but is deemed to be substantially related to the care of a child.
Failure to meet minimum requirements for a license pursuant to Wis. Stat. §. 48.68(1) and Wis. Administrative Code.
