6. When a Non-Delinquency Certificate is Issued After the Facility is Closed or the License Application is Denied

BECR may receive the nondelinquency certificate from DWD after BECR has closed the facility or denied the license application. Once BECR receives a nondelinquency certificate, BECR must reinstate the license or grant a person's application for the license unless there are other grounds for not reinstating the license or for denying the application for the license. One basis for not reinstating the license is that the license continuation date passed while the license was revoked so the license was not continued.

BECR staff should make a determination, on a case-by-case basis, as to what will be needed to reinstate a license or proceed with the license application following the facility closure or application denial. This may require updating an application and/or submittal of other time-sensitive documentation (e.g., caregiver background check information), or a site visit. Such a determination is based on the length of time that has passed since the facility was closed or license denied. Generally, if BECR receives the nondelinquency certificate within 60 days of BECR’s final notice that the facility is revoked or denied, BECR can reinstate the license or grant a person’s application for a license without additional documentation. However, if more than 60 days has elapsed and/or relevant circumstances have changed, BECR staff should consider asking for documentation that demonstrates that the provider or applicant remains eligible for child care licensure. If the period for which the license had been issued has expired, the provider may be required to submit license continuation materials.

The licensing manager/licensing supervisor should consult with the OLC attorney to determine what new or additional documentation may be needed or is permitted.

To reinstate a license, BECR regional office staff must issue the Withdrawal of Revocation and reopen the facility in WISCCRS. The General Comments field in WISCCRS must be updated to include documentation on what has occurred with the delinquent unemployment insurance contributions and license reinstatement. Because Wisconsin Shares and YoungStar staff receive the final notification of a revocation or denial, these agencies must be notified by BECR that the enforcement has been withdrawn.

Note that the licensee is not eligible for retroactive payments of Wisconsin Shares for the period of closure.
