Child Care Licensing Procedure Manual
Pursuant to Wis. Stat. §§ 48.715(7) and 108.227(1)(d), BECR must deny or revoke a child care license if DWD certifies that the applicant or licensee is liable for delinquent UI contributions. By the time that BECR receives notification from DWD of an applicant/licensee’s delinquent UI contribution status, the applicant or licensee will have already received several DWD warning letters and separate notifications from DWD of the delinquent UI contribution certification, including a certified notice of liability for delinquent contributions.
As required under Wis. Stat. § 108.227(2)(b), upon receipt of a UI delinquency notice, a BECR-assigned staff person prepares a Denial - 30-Day Notice or a Revocation - 30-Day Notice. The letter is submitted to the licensing manager/licensing supervisor for review and signature. The letter notifies the applicant or licensee of their right to have the certificate of delinquent UI contributions on which the license denial or revocation is based reviewed at a DWD hearing, as specified in Wis. Stat. § 108.227(5). The written request for hearing must be filed with DWD within 30 days of the denial or revocation letter. Under Wis. Stat. § 108.227(5)(a), the issues at the hearing before DWD are limited to the questions of either mistaken identity of the applicant or licensee, or prior payment of the delinquent UI contributions. Attached to BECR’s denial or revocation letter is a copy of the certificate showing the liability for unpaid UI contributions.
The denial or revocation letter is sent to the applicant or licensee by certified and regular U.S. mail. A copy of BECR’s denial or revocation letter is shared with DWD.
DWD will notify BECR if a hearing is requested. In the event that a hearing is conducted, an unfavorable decision by the DWD hearing examiner can be appealed to the Dane County Circuit Court under Wis. Stat. § 108.227(6).
The regional office manager is responsible for monitoring the region’s DWD folder and notifying the licensing manager/licensing supervisor and the licensing specialist if a nondelinquency certificate is issued prior to, or in response to, the issuance of the denial/revocation. In this case, the regional office manager withdraws the revocation using the Withdrawal of Revocation.
The regional office follows usual procedures for entering enforcement actions into WISCCRS.
