Child Care Licensing Procedure Manual
When the licensing specialist completes the desk review or on-site investigation and determines that one or more administrative rule violations led to the incident, accident, injury or death, the licensing specialist cites the violations on the Noncompliance Statement and Correction Plan, informs the licensee that a noncompliance statement will be issued, and mails, emails, or delivers the noncompliance statement to the licensee. The licensee is instructed to initiate corrective action as soon as possible.
The completed Noncompliance Statement and Correction Plan must be mailed, emailed, or hand delivered as soon as possible, but no later than 10 business days from the date of the completion of the desk review or the site visit during which the violation(s) was cited. This applies even if an order or other enforcement action will be forthcoming. The only exception to this ten-day time frame is when further information must be obtained following the site visit or there is a specific reason to wait related to a planned enforcement action. The licensing specialist should make this decision in collaboration with the licensing manager/licensing supervisor.
Note: Licensing specialists must adhere to all requirements related to issuance of the Noncompliance Statement and Correction Plan, including requirements for an exit interview with family child care providers.
