When an illegally operating provider has been issued an Order to Stop Operating Child Care Without a License but has not complied with the order, the next step is to issue the Forfeiture - Unlicensed letter to assess a forfeiture amount. Wis. Stat. ยง 48.715 provides BECR with the authority to impose a penalty against any person who violates a statutory provision of licensure or a rule promulgated under the statute, or who fails to comply with an order issued by BECR. Forfeiture amounts may be set at $10 to $1,000 per day, per violation and must be paid within 10 days of receipt of the forfeiture assessment notice. The person may appeal the forfeiture by requesting an administrative hearing with the Department of Administration, Division of Hearings and Appeals, within 10 days of the date of the notice.
