6.1.1 Follow-up On-Site Visit to Ensure Compliance with the Order

The licensing specialist should make a site visit to verify that the order has been complied with following issuance of the order. This follow up verification visit should be done from two weeks up to two months following issuance of the order.

If the order has been appealed, there is no need to wait for a hearing decision prior to making the verification visit. If possible, this site visit should be scheduled in conjunction with a scheduled visit to another center in the area. If the on-site visit reveals that the provider is operating illegally despite issuance of the order, the licensing specialist should consult with the licensing manager/licensing supervisor regarding whether to issue a forfeiture and/or make a referral to the District Attorney for an injunction or prosecution. (See sections 6.2 and 6.3.) If the site visit confirms that the provider is not illegally operating, the substantiated complaint is considered closed.
