6.1 Issuing an Order to Stop Operating

When a provider has failed to comply with Wis. Stat. ยง 48.65, the licensing specialist consults with the licensing manager/licensing supervisor regarding issuing an order to stop operating as the first enforcement step. The order, which is signed by the licensing manager/licensing supervisor, states that the provider must immediately stop providing illegal care and outlines additional enforcement actions that may be taken if the provider fails to comply with the order. The Order to Stop Operating Child Care Without a License is available on the BECR Intranet.

The provider may appeal the order by requesting an administrative hearing with the Department of Administration, Division of Hearing and Appeals, within ten days of the date of the notice. If the provider appeals the order and prevails, the case is closed. If the provider does not prevail, the order stands and the licensing specialist should then proceed with the follow-up on-site visit to verify that the number of children in care has been reduced.
