3.3.1 When Jurisdiction to Investigate Does Not Exist

Rarely, a complaint received by BECR will not involve any alleged violations of licensing administrative rules and BECR’s regulatory authority to investigate the complaint will not exist, regardless of whether the complaint is valid or not. In this case, the licensing specialist should inform the complainant of this (when possible), either by phone or in writing, indicating why the matter is not under the jurisdiction of licensing staff. The licensing specialist then closes the complaint and deletes it from WISCCRS. The CFS-321 and CFS-321-B are discarded.

If a complaint is received alleging violations related to receipt of Wisconsin Shares, the complainant should be referred to the Wisconsin Shares Fraud Mailbox. Staff from the DECE Bureau of Child Care Subsidy Administration will record and screen the complaint and conduct any necessary follow up investigation. BECR does not document the complaint in WISCCRS.
