Child Care Licensing Procedure Manual
If a rule violation related to the complaint allegation is substantiated, subsequent action must be taken. The licensing specialist must assess whether monitoring should be increased, a citation(s) should be issued and/or further enforcement action should be taken. Things to consider are:
Does the compliance history of the center suggest a pattern of similar violations in previous monitoring visits or complaint investigations?
Is the level of risk such that it is safe to rely on routine corrective action to restore timely compliance with the rules?
Should special conditions be placed on the license? For more information, see the procedure chapter on Stipulations.
Is an enforcement action needed, such as an order or forfeiture, and if so, which one would best assure immediate and continued compliance? Would a warning letter serve the purpose of alerting the licensee to the seriousness of the violation(s)? Is it necessary to take stronger enforcement action, such as a summary suspension or revocation? For more information, see the appropriate procedure manual chapters in the Enforcement Actions section.
The licensing specialist must discuss the need for serious enforcement actions and/or placing special conditions on a license with the licensing manager/licensing supervisor. These actions must be authorized by the licensing manager/supervisor before undertaken.
