15.1 Licensed Providers

Pursuant to s. 48.66(5), Wis. Stats, a licensee who has applied for a continuance of a license must pay any and all outstanding licensing fees, caregiver background check fees, forfeitures, non-sufficient fund fees and late fees before the license may be continued. All fees and forfeitures must be paid before continuation unless the currently licensed provider has entered into an installment agreement (described below) or the provider has filed for bankruptcy protection. Generally, bankruptcy protection prevents further collection of BECR-initiated debt if the debt was included in the bankruptcy legal filing. If the licensee has filed for bankruptcy, the licensing manager/licensing supervisor must be consulted to determine whether to make further efforts to collect the debt.

If the licensee has agreed to an installment plan for paying outstanding fees and there is still a balance due at the time of license continuation, the BECR Regional Office staff person handling the continuation should consult with the licensing manager/licensing supervisor regarding whether the license should be continued. For example, an approved forfeiture installment agreement may be in place and the licensing manager/licensing supervisor will consider the licensee’s history of making timely installment payments in determining whether to continue the license.
