6.8 Forfeiture - Licensed Programs Only

If the provider does not comply with the Order to Correct and Imposed Plan of Correction within 15 days, the BECR CBU issues a Notice of Forfeiture Assessment for $250. The CBU Supervisor and the CBU Operations Chief must approve the decision to assess the forfeiture. BECR is required to provide written notice of the grounds for forfeiture, an explanation of the type of penalties imposed and an explanation of the process for appealing the forfeiture. The notice is issued in conjunction with a CFS-294 and is sent by certified and regular mail.

If the provider does not comply with the imposed plan of correction within 60 days, the CBU issues a second Notice of Forfeiture Assessment for $500. Forfeitures of $500 or more require the BECR Director’s approval. The notice is issued in conjunction with a CFS-294 and is sent by certified and regular mail.

When a licensee appeals a forfeiture, payment is suspended pending the outcome of an administrative hearing conducted by the Division of Hearings and Appeals. Otherwise, if not appealed, a forfeiture must be paid by the licensee within 10 days of receipt of the Notice of Forfeiture Assessment. Forfeitures are paid to the BECR Central Office. Failure to pay a forfeiture may result in revocation.

If the provider does not correct the violation and pay the forfeiture, the CBU Supervisor consults with the BECR regional licensing chief/licensing supervisor regarding next steps. The noncompliance must be reviewed, and a determination made jointly regarding further enforcement, such as revocation of the license.
