If the provider does not correct the violation described in the Warning Letter and related CFS-294 within 15 days, the CBU issues an Order to Correct and Imposed Plan of Correction.
The order to correct is considered an intermediate enforcement action. BECR must provide a written notice of the grounds for the order, an explanation of the types of sanctions or penalties imposed, and an explanation of the process for appealing the enforcement action. The imposed plan of correction is entered by the CBU in the correction plan section of the CFS-294. The imposed plan of correction specifically identifies the expectation of what the licensee must do to comply with the law (e.g., “The Background Check Request form of the new employee, Jane Doe, will be submitted by 8/1/2019.”). The order is issued in conjunction with a CFS-294 and is sent by certified mail and regular mail.
