6.4 Denials and Revocations Related to Background Check Eligibility Determinations

The certification agency or the CBU, in consultation with the BECR regional licensing office, is responsible for issuing enforcements (denial/revocation) resulting from a background check after ineligibility appeal period has lapsed.

There are various grounds (and thus statutory citations) for denial or revocation related to background check issues. The authority to deny or revoke a probationary or regular license is provided under Wis. Stat. § 48.686(4m) and (5m); 48.715(3), (5), (6) and (7), Wis. Admin. Code §§ DCF 250.11, DCF 251.11 and 252.05 and DCF 13.08 and 12.06. The authority for denial or revocation of certification is found in Wis. Stat. § 48.686(4m) and (5m) and DCF 202.06
