5.8.2 Pending Charge that is Potentially Substantially Related to Care

Often when no disposition is noted on the criminal history report, it is because the case has not yet been settled. In this situation, the CBU should contact the District Attorney to obtain the status and ongoing information until the final disposition is reached. A pending criminal charge of a non-serious offense cannot be the sole basis for substantial relationship or a bar under the background check law. However, the pending criminal charge of a non-serious offense may be the basis of an enforcement action or stipulation. The CBU will make the determination pending the outcome of the charge.
