5.7.3 Regulatory Approval and Eligibility Redetermination Following Rehabilitation Review Approval

Rehabilitation review approval only guarantees the right to be considered for regulatory approval, employment or household member residency as any other person who is not barred. A person with approval may still have their application denied, their license or certification revoked, or not be hired as an employee. While an eligibility redetermination review is needed, the particular offense that caused the bar and was considered when the rehabilitation review approval was granted cannot be used as the basis for denial or revocation, failure to hire, or substantially related determination. If the person with approval has committed a non-serious crime not included in the rehabilitation review, the CBU may consider that non-serious crime for a substantially related determination (licensee and applicants only).

If the CBU becomes aware that a licensee, operator, employee or household member with rehabilitation review approval has failed to adhere to any conditions imposed in conjunction with the approval, the CBU cannot use this as a reason for a substantially related determination. However, the CBU should report this to the DHS Office of Legal Counsel or DCF Office of Legal Counsel, depending on which agency approved the rehabilitation review. They will determine whether the approval should be rescinded and the original bar re-imposed.
