Child Care Background Check Procedures
The certification agency or BECR may do any of the following:
Hold the application pending the outcome of the investigation. If the outcome creates a bar, the CBU will issue the ineligibility determination notice. The certification agency or BECR will then deny the application based on Wis. Stat. § 48.686(4m) and Wis. Admin. Code §§ DCF 250, 251 252, or 202.
If the outcome of the investigation results is a substantially related finding, the CBU will issue the ineligible determination notice. The certification agency or BECR will then deny the application based on Wis. Stat. § 48.686(5m) and Wis. Admin. Code §§ DCF 250, 251 252 or 202.
Advise the applicant to withdraw the application pending the outcome.
If the pending charge is a “serious” crime, the CBU will issue an ineligible determination notice. The certification agency or CBU may then deny an application using the appropriate authority under Wis. Stat. § 48.686(5m), and Wis. Admin. Code § DCF 250, 251, 252 or 202.
When a case is held open for a specified length of time (deferred prosecution agreement), the CBU must determine if the pending crime is a barred offense or substantially related. If the individual completes the court’s conditions, the case may be dismissed. Dismissed charges will remain on a record but only actual convictions can be used to bar an individual.
