5.4.1 When the Barred Household Member Moves Out of the Facility

BECR or the certification agency may enter into a stipulated agreement with an applicant, licensee or operator rather than deny or revoke licensure or certification if the adult or minor household member who is barred moves out of the facility either on a temporary basis (for example, while seeking rehabilitation review approval or until charges are disposed of) or on permanent basis. BECR or the certification agency creates the stipulation, outlining the conditions and restrictions that ensure the provider prevents the barred person from being a resident.

BECR and certification agencies do not have the authority to disregard the background check law and the stipulation cannot violate or contradict the background check law by allowing a household member who has a barred offense to reside in the home. For example, BECR or a certification agency may not enter into a stipulation that prevents a household member with a barred crime from being on the premises during child care hours but still allows residence at the home.
