Child Care Background Check Procedures
It is possible that an individual’s criminal background check results indicate “no record” but CCAP indicates an arrest or conviction. Because not all criminal history appears on the DOJ results, the CBU reviews CCAP records as part of the initial background check screening.
All information in the criminal history database is based on the submittal of arrest fingerprints by law enforcement agencies. Wisconsin law enforcement agencies are required under Wis. Stat. §165.84(1) to submit arrest fingerprints for offenses designated in Wis. Stat. §165.83(2)(a) and the criminal history database also accepts any other arrest fingerprints taken at the discretion of law enforcement agencies for offenses other than those listed in Wis. Stat. §165.83(2)(a).
A fingerprint criminal check is not the ultimate determinant of criminal history. If a criminal record is identified through a fingerprint match, staff can be confident that the record belongs to the individual in question. However, if a fingerprint check is returned showing no criminal history, it does not guarantee the individual has no criminal history. The integrity of information available is dependent upon the diligence and consistency of every law enforcement agency and their data.
