Some offenses on the Barred Offenses Table specifically indicate if the barred offense is a felony or a misdemeanor. Because certain crimes on the Barred Offenses Table are barred only if they are felony convictions, CBU staff must review the statute and description columns carefully to determine if the bar applies only to a felony conviction. If not specifically indicated, both felonies and misdemeanors of that offense will result in a bar.
When identifying a bar on the Barred Offenses Table, the statute may need to be reviewed in detail for the numbering sequence and description of the offense here: http://docs.legis.wisconsin.gov/statutes/statutes/940/II/225. Sometimes seeing the organization of the entire statute helps in understanding the offense designations.
The CBU must determine whether a pending charge or conviction for a federal crime or from another state is comparable to an offense or conviction on the Barred Offenses Table. To determine whether a pending charge or conviction is comparable, the CBU may review other state’s criminal codes available on Cornell University Law School’s Website or consult with the DCF Office of Legal Counsel. In addition, the FBI website provides contact information for each state that can be used to obtain additional information about an out-of-state charge or conviction.
