Child Care Background Check Procedures
A name listed in this section of the IBIS results means the individual has completed a rehabilitation review. Information from all entities that conduct rehabilitation reviews are included in the IBIS response. The DHS Office of Legal Counsel and the DCF Office of Legal Counsel collect and maintain statewide rehabilitation review information. The appropriate Office of Legal Counsel phone number is provided so additional information can be obtained about the rehabilitation review decision from the relevant office.
Note: DCF did not begin conducting rehabilitation reviews for licensure or regulatory approval, employment, household member residency and contract services for the DCF-regulated entities until 2012. Prior to that time, rehabilitation reviews for licensed child care were conducted by DHS. Prior to October 1, 2018, local certification agencies and tribes conducted rehabilitation reviews for child care certification and reported rehabilitation review decisions to DHS and, starting in 2012, to DCF. Effective October 1, 2018, DCF is responsible for conducting rehabilitation reviews for child care certification, as well as for licensed programs. Tribal certification agencies, however, may choose to conduct rehabilitation reviews or refer the subject to DCF for review. Tribes choosing to conduct rehabilitation reviews must first submit and obtain DCF approval of their plan for rehabilitation reviews.
When an individual has been through a rehabilitation review, he or she has received a decision in writing from the panel that reviewed the case. The outcome of the review is stated in the letter. The decision may be one of the following:
Denial, which prevents licensure or regulatory approval, employment or household member residency in a licensed or certified facility;
Approval in full or part, with or without imposed restrictions;
Deferral of a decision until a future date, which continues to prevent regulatory approval or employment.
The CBU must review the rehabilitation letter to determine if the individual is rehabilitated for the setting or role for which they applied.
