4.3.3 Background Check Request Form Reveals a Charge or Conviction Not Listed on DOJ Results

If an individual self-attests on the Background Check Request form to a criminal charge or conviction on the Barred Offenses Table that does not appear on the DOJ criminal history results, the background check law requires the CBU to make “every reasonable effort” to contact the Clerk of Court to obtain a copy of the criminal complaint and the final disposition of complaint. A search of CCAP may provide the docket and case number that can be used to obtain the records from the Clerk of Courts. It may be necessary to conduct an out-of-state check or fingerprint background check if individuals disclose a criminal charge or conviction from another state.
