4.3.2 Disposition Not Noted

If the DOJ criminal history results indicate the existence of a criminal charge on the Barred Offenses Table but does not indicate the final disposition, the background check law requires the CBU to make “every reasonable effort” to contact the Clerk of Courts to determine the final disposition of the charge. County Clerks of Court are responsible for sending the final disposition information to the DOJ for arrests that occur in their county’s circuit court. If this information is not sent, the DOJ criminal record search response will state, “no disposition received” or “end of record.” In this situation, the CBU should search the Wisconsin Circuit Court Automation Program (CCAP) to determine the docket and case numbers that can then be used to obtain the record of the final disposition from the Clerk of Court.
