3.5 Conducting the Background Check During Temporary Closure

The BECR CBU continues to collect Background Check Request forms and conduct annual background checks when the child care program has the status of “temporarily closed”. During temporary closures, the Background Check Request form must be resubmitted or updated every 5 years, triggering the fingerprint background check, regardless of the temporary status.

For example, a licensee or operator may temporarily close due to an illness and the adult daughter is expected to move into the home. The Background Check Request form and a background check is required for this new prospective household member even though the facility is temporarily closed. If the licensee/operator fails to submit a required Background Check Request form during the temporary closure, the BECR regional licensing specialist or certifier may issue a noncompliance statement or other enforcement action. Annual name-based DOJ/IBIS background checks are still conducted on individuals subject to the annual check during the temporary closure.
