Child Care Background Check Procedures
A Background Check Request form is required for:
The licensing or certification applicants, including:
An individual, partnership or sole proprietor.
All members or managers of a Limited Liability Company (LLC).
The board president of a corporation or church, or other board member designated in writing by the president to fulfill the CBC requirement.
All residents/household (except foster children) members age 10 or older who reside at a child care program. (Although client residents, such as foster children age 10 or older, must submit a Background Check Request form, a background check is not conducted on client residents.)
All volunteers or substitutes in a licensed or certified child care facility who have unsupervised access to children.
All caregiver employees, providers, substitutes and volunteers who meet the definition of caregiver. (See caregiver definition in Section 1.6.)
Non-caregiver employees or contractors of a child care program. Non-caregiver employees are subject to the background check requirements if their work at the child care program provides the ability to move freely throughout the premises and to have opportunities for interactions with children in care.
Failure to comply with the requirements for submittal of the Background Check Request form may lead to actions that range from issuance of a noncompliance statement to enforcement actions, including denial or revocation of certification or licensure.
